Who we are

Fermata is operated by A350 Consulting AS, a Norwegian limited company (aksjeselskap). Throughout these terms, “Fermata”, “we”, and “us” mean that company.

What Fermata is

Fermata is a price-intelligence service for luxury hotel rooms. You set a target price on a specific room category for a specific date and we watch that exact room every night and email you when the price reaches your target. We track the room you pinned so the choice to book rests on its own price history rather than a property average.

About the prices and booking

Fermata is an information service. We do not sell rooms or take bookings, and we are not a travel agent. You book on the hotel’s or seller’s own site, at their terms, and your booking is a contract between you and them.

Rates are observed from public hotel and travel sites and refresh on a schedule, typically nightly. A rate can change between our observation and your booking, and it can differ with member status, currency, taxes, and length of stay.

Verify the price at the seller before you book. We make no guarantee that a rate we showed is still available.

Some booking links are affiliate links, currently those to Hotels.com. If you book through one, Fermata may earn a commission on the booking. It does not change the price you pay.

Who can use Fermata, and your account

Fermata is a paid contract service. To use it, you must meet a few conditions:

• The account details you give us are accurate and kept up to date.
• You use one account per person.
• You keep your sign-in to yourself; you are responsible for activity under your account.

We may suspend or close an account that abuses the service, for example through bulk scraping, reselling the data, or otherwise breaking these terms.

Plans and billing

There is a free plan and two paid plans:

• Free: one active tracker with a target price email alert, follow hotels, and see their 330 day forward price (one room).
• Premium and Pro: 330 day forward price for all rooms. Set up and see price history. Individual tracking of room price data. Set a target price on a specific room, and we email you when the price reaches it.

Paid plans bill monthly or annually through Stripe and auto-renew until you cancel. You can cancel anytime in the billing portal; your paid features stay active until the end of the period you have already paid for.

If we change the price of a plan, existing subscribers are emailed before the change takes effect.

Acceptable use

Fermata is for your personal use. When you use it, you agree to the following:

• Use the service for your own personal purposes.
• Keep to one account per person.
• Do not bulk scrape, harvest, or systematically extract the data.
• Do not resell or redistribute the data or analysis.

Our content and rights

Fermata, the site, and the compiled price data and analysis are ours. Using the service gives you a limited, personal, non-transferable right to use it for the purposes described in these terms. It does not transfer ownership of anything to you.

Limits of service

The service is provided “as is”. We work to keep it accurate and available, and we do not promise either. Prices are observations of public sources and can be wrong or out of date, and the service can be unavailable from time to time. Always verify a rate at the seller before you rely on it.

Liability

Our liability to you is limited to the fees you paid us in the preceding twelve months.

Nothing in these terms limits any liability that cannot be limited under applicable law, including liability for intent or gross negligence, for personal injury, or for a consumer’s mandatory statutory rights.

Changes to the service and these terms

We may change the service over time, and we may update these terms. If a change to the terms matters, account holders get an email before it takes effect. Continued use of Fermata after a change takes effect means you accept the updated terms.

Ending your use

You can cancel a paid plan anytime in the billing portal, and your paid features stay active until the end of the period you have paid for. You can ask us to delete your account entirely by writing to [email protected].

We may suspend or close an account that breaks these terms or abuses the service.
